PWEA presents an analyze of Polish and community law regulations, defining the protection rules of Natura 2000 areas, made to check permissibility of introducing to planning instruments (plans, programs, strategies) detailed prohibitions and restrictions to build wind farms on properties located in Natura 2000 areas and in their vicinity. It has to be emphasized that there is no base to identify category of “actions likely to have significant negative impact on the Nature 2000 area” which are mentioned in Article 33 Paragraph 1 u.o.p. with category “ventures likely to have significant impact on the environment” according to regulations of u.o.o.¶. Concept used by the legislator leaves no doubt that these categories are not identical.
